Terms & Conditions
1. The Grief Coach Terms & Conditions
1.1 Clients are expected to familiarise themselves with the scope and nature of the grief coaching sessions as outlined on relevant sales pages and through correspondence with The Grief Coach. 1.2 Coaching sessions will be conducted via Zoom, or in person at a disclosed location provided upon purchase. 1.3 It is important to understand that coaching is distinct from therapy or counselling. The Grief Coach does not hold qualifications in these fields and is not a licensed mental health professional. If professional medical support is needed, clients should contact their GP or seek private assistance. 1.4 Any concerns regarding safeguarding will be reported to the appropriate authorities by The Grief Coach.
2. Client Eligibility
2.1 All clients must be at least 18 years old. 2.2 Clients must not have any convictions or be subject to court orders related to sexual misconduct, harassment, violence, or any form of physical or mental abuse. 2.3 Any violation of this clause may result in the immediate termination of the agreement at the discretion of The Grief Coach.
3. Terms of Engagement
3.1 By engaging The Grief Coach, you agree to the terms outlined in this agreement.
3.2 This agreement begins when the first instalment or full payment is made and continues unless terminated by either party.
4. Sessions & Cancellation
4.1 Each coaching session, whether via video call, telephone, or in person, will adhere to the agreed duration.
4.2 Refund Policy: Once payment is made, the client is responsible for the full fee. No refunds will be issued if the client cancels.
4.3 Rescheduling Policy: Sessions can be rescheduled with at least 24 hours' notice via phone or email.
4.4 Cancelled sessions will be rescheduled at the earliest mutually convenient time. 4.5 If the client fails to attend a session without the required 24-hour notice, The Grief Coach reserves the right to retain the fees paid.
4.6 Sessions will start at the agreed time. If the client is late, the session will still end at the scheduled time.
4.7 Clients may be asked to complete an insight questionnaire prior to the first session, to be returned 24 hours before the session starts.
4.8 Session times may vary during school and public holidays; please check for notices.
5. Duties of The Grief Coach
5.1 The Grief Coach will provide services with appropriate care, skill, and professionalism.
5.2 No guarantees of specific outcomes are provided due to the nature of coaching.
6. Fees
6.1 Fees for services will be confirmed at the time of consultation.
6.2 All sums payable under this agreement are due immediately upon termination of the agreement.
6.3 This clause does not affect any right to claim interest under the law or this agreement.
7. Data Protection
7.1 Personal data will be processed in compliance with data protection laws.
7.2 Clients are prohibited from copying, sharing, or selling any materials or content provided during sessions without written consent.
7.3 Audio or visual recordings of sessions are not permitted without prior written consent.
7.4 Non-Disparagement: Disputes will be resolved under English Law, and parties agree not to engage in any behaviour or communications that disparage the other.
8. Liability
8.1 Nothing limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
8.2 The Grief Coach is not liable for delays or failures caused by circumstances beyond control.
8.3 Total liability for any claims in connection with this agreement is limited to the total price paid for the sessions.
8.4 The Grief Coach is not liable for costs, charges, or losses resulting from the client's actions or omissions or circumstances beyond control.
8.5 All implied warranties and conditions are excluded to the fullest extent permitted by law.
9. Third-Party Rights
9.1 No third party has the right to enforce any terms of this agreement. 9.2 Termination or rescission of this agreement does not require consent from any third party.
10. Governing Law
10.1 This agreement and any disputes arising from it will be governed by and construed in accordance with English Law.
11. Confidentiality
11.1 The Grief Coach will handle all client information in compliance with the Data Protection Act 1998 and any subsequent amendments.
11.2 Clients consent to The Grief Coach holding their personal information.
11.3 The Grief Coach will not disclose client information unless required by law, a court order, or a regulatory authority.
